DARIEN E BONNEY Ordered to Pay Restitution

DARIEN EUCLID BONNEY (DARIEN E BONNEY) of Scottsdale, Arizona, was ordered to pay $1.98 million in restitution and $30,000.00 in penalties by the Arizona Corporation Commission and Bonney’s Arizona securities salesman registration was also revoked, according to a recent article in the Daily Independent of Phoenix. Bonney was a broker with MML INVESTORS SERVICES LLC of Scottsdale, Arizona from 04/02/2007 - 01/27/2022.

According to the Daily Independent article, the Commission found DARIEN E BONNEY allegedly solicited certain clients to invest in short-term bridge loans to benefit a startup company in which Bonney had an ownership interest. Bonney allegedly drafted and issued promissory notes to the investors, misrepresenting to them that the investment was a “no-risk deal” with double-digit, “guaranteed” investment returns. The article goes on to say that the Arizona Corporation Commission stated that Bonney engaged in “selling away,” in which a registered salesperson sells products that have not been approved by his or her dealer.

According to FINRA’s BrokerCheck available to the public on FINRA’s website, DARIEN E BONNEY was in the securities industry for 16 years and was listed with 2 firms.  Bonney has 8 disclosures on his FINRA CRD report.  Five of the disclosures are “Customer Complaints,” 3 have settled and 2 are pending.  The significance of DARIEN E BONNEY’s disclosures is underscored in FINRA NOTICE to MEMBERS 03-49. FINRA conducted a review of the CRD’s of all registered representatives, only .41% had been the subject of 3 or more customer complaints. In other words, DARIEN E BONNEY’s customer complaints rank him in the top one-hundredth percent of all registered representatives for customer complaints. 

On 1/20/2022 there is an “Employment Separation after Allegations” discharging DARIEN E BONNEY from MML INVESTORS SERVICES LLC following the allegations of, “Registered Representative terminated in connection with an investigation into an undisclosed outside business activity and unauthorized investment activity.”

There have been 2 “Regulatory” disclosures filed against Bonney. On 5/6/2022 the “Regulatory” disclosure filed against Bonney, permanently barred DARIEN E BONNEY with allegations of, “Respondent Bonney failed to respond to FINRA requests for information.”

On 8/9/2023 another “Regulatory” was filed against Bonney ordering him to “Cease and Desist,” fining him $30,000.00, and ordering him to pay restitution of $1,980,000.00. The allegations are, “Mr. Bonney violated A.A.C. R14-4-130(A)(17) by effecting the MERCO transactions without first receiving approval from MMLIS and without the transactions being recorded on the records of MMLIS. Respondent's conduct is grounds for revocation of his securities salesman registration pursuant to A.R.S. § 44-1962.”
