According to FINRA, the client filed the claim in December of 2018 against Stifel, Nicolaus & Co, and their financial advisor, John Raymond Lisowski. The claim alleged breach of contract, breach of fiduciary duty, negligence, common law fraud, failure to supervise and other violations, according to FINRA. The claims were related to alleged failure on the part of Lisowski to recommend a suitable investment strategy and asset allocation, including over-concentration in certain stocks, and unauthorized and excessive trading, and investment in unsuitable securities, according to FINRA.
According to the FINRA report, the client was seeking $390,000 in damages, disgorgement of profits and excessive commissions, damages as authorized by the Pennsylvania Unfair Trade Practices and Consumer Protection Law, lawyers’ fees and costs, and punitive damages. The FINRA panel ordered Stifel, Nicolaus & Co and John Raymond Lisowski to pay $500,000 in compensatory damages. The other claims were denied.
According to FINRA’s BrokerCheck, available to the public on FINRA’s website, John Raymond Lisowski, has been registered in the securities industry for 38 years. The Customer Dispute listed on his report dated September 17, 2018, allegations were, “Customer alleges that registered representative mishandled customer's account through unsuitable, unauthorized, and excessive trading.” The requested damages listed were, $390,000.00 and the damages granted were 500,000.00.
