Did You Invest in Aequitas Management, LLC?

The U.S. Securities and Exchange Commission (SEC) sued the Oregon-based Aequitas Capital Management LLC, March 10, 2016, and three of the top executives for allegedly running a $350 million Ponzi scheme. It also removed the chief executive, Bob Jesenik, and his partner, Brian Oliver, from positions at the company. The SEC named Jesenik, Oliver and Scott Gillis, the former chief financial officer, as defendants in the complaint.
According to the SEC, the company allegedly defrauded more than 1,500 investors.  The investors believed they were investing in health care, education and transportation-related investments, when in fact their funds were being used in an effort to save the firm.
Allegedly, since 2014, the company used much of the money it raised from new investors to fund operating expenses and to pay off existing investors.  Many of these investors were in their 80s and 90s and lost their life savings after investing in the company.
This scandal could spread beyond Oregon. The company convinced independent investment advisors from across the country to sell their private note investments. The company paid many of them 2% commission for every dollar they sold in its private notes.  Many investors are now suing the company and their own investment advisors or both.  Some investors are also suing the Portland law firm representing Aequitas Capital Management and the accounting firm which prepared their audited financial statements.  Many of the investors feel the accounting and law firms helped enable this massive Ponzi scheme. Investors have about $600 million in Aequitas private notes and in various Aequitas investment funds.
