FINRA Sanctioned Arnella for Misleading Statements
Specifically, on September 5, 2024, FINRA issued Case No. 2020069039302. Specifically, Arnella was fined $5,000 and suspended for one month from associating with any FINRA member in all capacities. Evidently, FINRA alleged that Arnella made promissory and unwarranted statements about a publicly traded company and predicted the future performance of the company's stock.
According to FINRA, between June 2017 and June 2020, Arnella made public statements, including a written prediction of the company’s future stock price by the end of the year. Additionally, he communicated to two firm clients in writing about overturning a company’s loss in a patent litigation trial. FINRA found these statements to be in violation of FINRA Rules 2210(d)(1)(B), 2210(d)(1)(F), and 2010, which prohibit misleading, exaggerated, or promissory statements in public communications.
Arnella entered into a Letter of Acceptance, Waiver, and Consent (AWC) with FINRA, agreeing to the sanctions without admitting or denying the findings. His suspension began October 7, 2024, and concluded November 6, 2024. He paid the $5,000 fine on September 30, 2024.
