Did You Invest in TNP 2008 Participating Notes Program LLC (TNP 2008 PPM)?

Soreide Law Group is investigating claims on behalf of investors who suffered investment losses in several TNP sponsored investments, including the TNP 2008 Participating Notes Program LLC, sold by Berthel Fisher & Co. Financial Services Inc., and other firms. Berthel Fisher was the underwriter, promoter, and Managing Broker/Dealer of the TNP 2008 Participating Notes Program, and had a close relationship with Thompson National Properties, LLC, the sponsor of the TNP 2008 Participating Notes Program. Berthel Fisher was responsible for recruiting investors. TNP 2008 Participating Notes Program raised approximately $26,224,903.

Berthel Fisher failed to make the proper disclosures and perform adequate due diligence regarding the TNP 2008 Participating Notes Program. Berthel Fisher allegedly prepared the private placement memorandum for the TNP 2008 Participating Notes Program, which allegedly contained several material misrepresentations.

Berthel Fisher allegedly failed to investigate many red flags regarding the TNP 2008 Participating Notes Program. These included the deteriorating financial condition of Thompson National Properties, LLC, the sponsor of the TNP 2008 Participating Notes Program, which included TNP's default on $1.3 million in financial obligations, the high rates and return offered by TNP, of up to 13%, sales commissions of up to 10%, and commingling of funds, to name a few.
