How 457(b) Plans Move Into An IRA

A 457(b) plan is a deferred compensation plan, mostly for state and local government workers. Some nonprofits offer a different version. Governmental 457(b) money can generally roll into an IRA after the worker leaves the job. Non-governmental plans follow stricter rules, and many do not allow that move at all.

How the money moves matters for taxes. A direct rollover between custodians usually avoids current tax. A check paid to the worker, on the other hand, can trigger withholding and income tax. These rules frame the type of question raised in the Eric Heiting dispute.

What Eric Heiting's Settled Dispute Shows On BrokerCheck

A settled dispute shows that a customer complaint ended with a payment. A settlement is not an admission of wrongdoing, and it is not a finding. Firms settle for many reasons, including the cost of a hearing.

When we read an older settled dispute, we look at the dates and the product first. Eric Heiting's report lists the settlement amount alongside the customer's damage figure.

The Eagle Strategies Rollover Complaint Against Eric Heiting

The customer's complaint reached the firm on May 24, 2010. According to BrokerCheck, the customer alleged that in or around September 2009, Eric Heiting misrepresented that the customer's 457(b) plan could roll over into an existing IRA account. The customer also alleged that Heiting said there would be no tax liability.

The disclosure lists a mutual fund as the product and alleged damages of $34,549. The dispute settled on October 14, 2010, for $35,549.

The Firm's Duty To Supervise

Most investor claims are filed against the firm as well as the individual broker. Every FINRA member firm must keep a supervisory system and written procedures for overseeing its brokers. That means reviewing the accounts, the trading activity and the brokers' communications with customers. If a firm misses a problem it should have caught, it can be held responsible for the customer's losses. That is why a firm's supervision of the account is a central question in many FINRA arbitrations. The firm, not the individual broker, is also the party most able to pay an award or a settlement.
