SEC Wells Notice And Client Disputes Involving Garrett Moretz

Investment Losses?

A notice dated May 1, 2023, indicates that the SEC issued a Wells Notice to Moretz, alleging violations of specific federal securities laws including Section 10(b) of the Securities Exchange Act and Rule 10b-5. The investigation is currently pending. Moretz has stated his cooperation with the investigation but denies any wrongdoing.

Lifemark Securities Corp. Client Alleges Unsuitable Recommendation By Garrett Moretz

A client of Lifemark Securities Corp. raised allegations against Garrett Moretz through FINRA Arbitration: 22-02386. The client alleged that between January 2018 and October 2020, Moretz recommended an unsuitable investment in an alternative product. The investment turned sour when the issuing company filed for Chapter 11 bankruptcy. The client claims that the investment recommendations were based on insufficient due diligence and included material misrepresentations and omissions. Lifemark Securities Corp. reached a settlement for this case on September 26, 2023, agreeing to pay $119,750. Moretz, according to his statement, contends that the investment matched the clients' risk profiles and investment strategies and that all risks were fully disclosed.

Moretz Disclosed Breach Of Fiduciary Duty Allegations By Lifemark Securities Corp. Client

Evidently, a client of Lifemark Securities Corp. filed FINRA Arbitration: 22-01575. Supposedly, Moretz recommended an improper investment between February 2020 and January 2021. The product, a corporate debt security, led to the clients filing a complaint after the issuing company entered Chapter 11 bankruptcy. Notably, the allegations include a breach of fiduciary duty and various FINRA rule violations. A settlement was reached on July 19, 2023, for $100,000. However, Moretz stated that he made suitable recommendations.
