UBS Investors’ Misrepresentation Claims Involve Mark Elias

Allegedly, Elias advised the client to invest in and maintain an options overlay strategy, which was claimed to be unsuitable and misrepresented. Therefore, the client seeks compensatory relief from UBS Financial Services Inc. or Elias in the amount of $600,000.00 in this ongoing matter.

Also, on September 16, 2022, a UBS Financial Services Inc. client filed FINRA Arbitration: 22-02026 about Mark Elias. Similar to the other clients, this investor alleged that Elias recommended an investment and holding strategy in an options overlay that was unsuitable and misrepresented during 2016-2019. Therefore, the client requested $1,000,000.00 in compensation from UBS Financial Services Inc. or Elias. Evidently, this arbitration is pending a resolution.

Arbitration Award Against UBS Financial Services Inc. For Breach Of Fiduciary Duty Concerning Yield Enhancement Strategy

Notably, a client of UBS Financial Services Inc. contested Mark Elias’s sales practices by filing FINRA Arbitration: 19-02550. Notably, the client’s Statement of Claim against UBS Financial Services Inc. alleged misrepresentation, unsuitable recommendations, breach of contract, and breach of fiduciary duty. In addition, the client alleged violation of state and federal laws. Supposedly, the UBS securities broker portrayed Yield Enhancement Strategy (YES) as a low risk option, causing the client to sustain damages by investing in the strategy. Therefore, FINRA Arbitrators issued an Award dated September 15, 2021, compelling UBS Financial Services Inc. to compensate the client in the amount of $357,831.22 in compensatory damages.
