Timothy Walsh Settled Customer Disputes Over Portfolio And Annuity Sales
Timothy Walsh (CRD 4666856) settled a customer dispute over his management of a client's portfolio, according to his BrokerCheck report. A customer filed the dispute on July 11, 2024, under docket number CV24-0353-173, while Walsh was registered with Xenith Financial Advisory Services.
Walsh also settled an earlier dispute from 2017 over the sale of a variable annuity while registered with World Choice Securities.
A customer alleged that Timothy Walsh failed to manage the customer's portfolio in light of the customer's age, investment objectives, and risk, pursuing litigation in Texas state court to recover a loss of investment value based on an alleged breach of fiduciary duty. The case went before the District Court of Henderson County in Athens, Texas.
Walsh denied all claims in the litigation. The firm then offered a recision, and the dispute settled on March 12, 2025 for $135,500 against $250,000 in alleged damages. Walsh made no contribution to the settlement.
A financial advisor's duty to manage a portfolio in light of a client's age, objectives, and risk tolerance is a basic suitability obligation under FINRA rules. A strategy that no longer fits a client's circumstances, for example a client approaching retirement, can later form the basis of a breach of fiduciary duty claim.
The 2017 World Choice Securities Variable Annuity Dispute
A client bought a variable annuity that funded in February 2016, then followed Timothy Walsh to a new firm in June 2016, according to the disclosure. The client later filed a dispute on May 8, 2017, under docket number 17-01114, claiming he was not a savvy investor.
The dispute then settled on August 22, 2017 for $25,000 against $95,000 in alleged damages. World Choice Securities said in a statement that the parties named in the complaint settled separately and that Walsh, under his representative contract, was responsible for the settlement cost, FINRA fees, and legal representation, and that the firm had not collected payment from him.
A variable annuity is an insurance contract that invests premiums in underlying funds, and it often carries surrender charges and other fees during an early withdrawal period. Suitability for a variable annuity depends on a customer's time horizon, liquidity needs, and investment experience, according to FINRA guidance on the product.
