Notably, FINRA alleged that Morton failed to provide information and documents to FINRA when it conducted an investigation.
In January 2023, Allstate Financial Services, LLC terminated Morton's employment and submitted a notice (Form U5) stating that Morton was terminated by the parent company for allegedly having an undisclosed interest in an insurance agency, which was supposedly considered an outside business activity.
FINRA’s Request Denied By Tracy Morton
On January 18, 2023, FINRA sent a request to Morton as part of its investigation into the alleged undisclosed outside business activity. The request, made under FINRA Rule 8210, asked for the submission of information and documents by February 1, 2023.
Supposedly, FINRA told Morton that failing to comply with this request would be a violation of FINRA Rule 8210 and could result in sanctions, such as being barred from the securities industry. However, Morton allegedly has not provided the requested information and documents to FINRA up to the present time.
Also, Morton's communication with FINRA staff in February 2023 confirms her receipt of the request. Notably, she agreed not to provide the requested information and documents at any point.
By refusing to provide the requested information and documents in accordance with FINRA Rule 8210, Morton violated both FINRA Rules 8210 and 2010, according to the AWC.
