William Carlton Charged By SEC With Breach Of Fiduciary Duty

Evidently, the Securities and Exchange Commission filed Complaint: 2:24-CV-01542 on September 27, 2024. Allegedly, Carlton engaged in a scheme involving the improper allocation of stock trades, a practice commonly known as “cherry picking.”

From 2015 through 2022, Carlton allegedly executed trades in his accounts and waited to see how the stock prices moved during the trading day. When a stock increased in price, he kept the profitable trades for himself. When a stock declined, he shifted those losing positions into his clients’ accounts. By doing this, Carlton allegedly secured millions of dollars in profits for himself while transferring the losses onto his clients. The SEC contends that this conduct amounted to a breach of his fiduciary duty and violated federal securities laws. The case remains pending in federal court in Seattle, Washington.
