Lehman Notes And Other Settlements From 2008 To 2014

A complaint received on April 10, 2008 settled on December 23, 2008 for $100,000. Amir Navab's report lists alleged damages of $5,000 for that matter.

Claimants filed an arbitration on September 21, 2009, docket number 09-04911, seeking $1,430,000. The case settled on March 16, 2011. According to the firm's statement, the $822,500 settlement included the claimants returning their Lehman notes to UBS.

Why Issuer Credit Matters With Structured Notes

A structured note is a debt obligation of the bank that issues it. Its return may track a market index, but repayment still depends on the issuer's ability to pay. If the issuer fails, holders become creditors in its bankruptcy.

The 2009 dispute on Amir Navab's report involved Lehman notes. In our experience, claims like this turn on what the customer heard about issuer risk before buying.

Amir Navab And The 2024 Great Gable Wealth Management Claim

The newest claim on Amir Navab's report, docket number 01-24-0000-1096, arrived on January 9, 2024. According to BrokerCheck, it raised various claims and damages tied to portfolio and investment accounts. It listed alleged damages of $180,000 and settled on June 24, 2024.

How Excessive Trading Claims Work

Churning means trading an account too often, mainly to earn commissions for the broker. It can happen when the customer approves each trade, not only when the broker trades on discretion. FINRA treats excessive trading as a suitability problem. Since June 2020, Regulation Best Interest also bars a series of recommended trades that is excessive for a retail customer. Two numbers usually frame these claims. The turnover rate shows how many times the account's value traded in a year. The cost-to-equity ratio shows what the account had to earn just to cover its trading costs. When we review a churning claim, we start with those two numbers and the monthly statements.

Why Diversification Matters In These Claims

Overconcentration means putting too much of an account into one stock, one sector or one type of product. When that holding falls, the whole account falls with it. A broker's recommendations have to fit the customer's investment profile. That profile includes age, other holdings, risk tolerance, liquidity needs and time horizon. As a result, a large position that suits one investor can be wrong for a retiree who needs steady income. When we review a claim like this, the account statements usually tell the story. They show how large the position grew, and for how long.
