DANIEL JAMES O'NEILL Formerly of Aegis Capital

Family Broker Fraud

According to FINRA’s BrokerCheck, there is a pending “Regulatory” disclosure dated July 29, 2021, against:
DANIEL JAMES O'NEILL (DAN O'NEILL, DANIEL J ONEILL) CRD#: 1358245
O’Neill’s latest employment from April 23, 2013 to July 29, 2021 was with AEGIS CAPITAL OF MELVILLE, NEW YORK.
The allegations listed in the Regulatory complaint that is currently “pending,” were that DANIEL JAMES O'NEILL was named a respondent in a FINRA complaint alleging that he excessively and unsuitably traded one of his client's accounts.
The FINRA complaint alleges that O'Neill exercised de facto control over the trading in the client's account, controlling the volume and frequency of trading, deciding what securities to buy and sell, the quantities, the price, and when each trade would occur. According to the FINRA allegations, DANIEL JAMES O'NEILL also exercised control when he allegedly executed unauthorized trades in the client's account and the trading in the client's account was also excessive when measured against the annualized turnover rate and cost-to-equity ratio.
According to FINRA, DANIEL JAMES O'NEILL’s, active trading allegedly caused the client to incur $140,109 in costs and $147,411 in losses, while generating substantial commissions for O'Neill. O'Neill's trading generated gross sales credits and commissions of $110,446, of which O'Neill received at least $66,000, according to the FINRA complaint. FINRA alleges that O'Neill did not have a reasonable basis to believe that the level of trading he recommended was suitable for the client. The complaint also alleges that O'Neill effected trades in the client's account without first obtaining authorization or consent for the trades from the client.
According to BrokerCheck, available to the public on FINRA’s website, DANIEL JAMES O'NEILL has been in the securities industry for 36 years, was listed with 13 firms, and is not currently registered.  O’Neill has 10 disclosures on his FINRA CRD report.
One of the disclosures on O’Neill’s CRD report is an “Employment Separation After Allegations,” dated July 29, 2021.  DANIEL JAMES O'NEILL was discharged from Aegis Capital Corp following the allegations of, “Representative failed to keep the firm apprised of the status of the pending enforcement investigation which resulted in the initiation of a formal enforcement proceeding against the representative. Representative named in an enforcement proceeding alleging conduct inconsistent with firm standards.”
