The complaint prompted an internal review, which was ongoing on December 21, 2023, when Clemente submitted his resignation. The internal review concluded that Clemente violated firm policies.

Thornwater Company LP Investor Accused Clemente Of Negligence

Particularly, a The Thornwater Company LP client filed NASD Arbitration No. 00-04269 about Guy Clemente. Mainly, the client alleged omission of facts, breach of fiduciary duty, unauthorized trading of stocks, negligence, suitability, omissions, and misrepresentations. For this reason, on October 27, 2003, an NASD Arbitration Panel issued an Award ordering Clemente to pay the client $92,697.40 in damages.

Guy Clemente Disclosed Breach Of Contract Allegations By Commonwealth Associates Client

Additionally, a client of Commonwealth Associates contested Guy Clemente’s sales practices by filing NASD Arbitration No. 97-01462. Allegedly, Clemente omitted facts, breached a contract, was negligent, and made misrepresentations. It appears that Clemente caused the client to sustain damages. Because of this, NASD Arbitrators issued an Award dated May 21, 1998, compelling Commonwealth Associates to compensate the client in the amount of $40,000.
