Lawsuit Filed against ARKADIOS CAPITAL & JAMES T WALESA

Soreide Law Group Filed A Lawsuit On Behalf of a Client Before FINRA

Soreide Law Group has filed a FINRA arbitration on behalf of our client (Claimant) against:

ARKADIOS CAPITAL and their former registered representative, JAMES T WALESA (Respondents).

The Claimant is representing a trust and living in Nevada.  The lawsuit alleges that ARKADIOS CAPITAL broker, JAMES T WALESA, recommended $200,000.00 to be invested into a speculative private placement, AIU Alternative Care, Inc., also known as “Clearday,” which allegedly sold senior care products and offered residential care and adult daily care services. Another $100,000.00 was added to the initial investment at a later date.  According to the lawsuit, JAMES T WALESA presented it as a risk free investment. WALESA allegedly told the Claimant that the stock could not drop below $10 per share. This investment later proved to be worthless.

The lawsuit claims that the Respondents allegedly over-concentrated $300,000.00 of the Claimants life savings. The lawsuit is alleging; negligence, breach of fiduciary duty, and negligent supervision.

According to FINRA’s BrokerCheck, available to the public on FINRA’s website, JAMES T WALESA has been in the securities industry for 39 years and was listed as a broker with 8 firms. He is currently not registered. Walesa was with ARKADIOS CAPITAL from 09/04/2019 - 12/17/2021. Walesa has 8 disclosures on his FINRA CRD report, 7 are “Customer Disputes.” The significance of JAMES T WALESA's customer complaints is underscored in FINRA NOTICE to MEMBERS 03-49. FINRA conducted a review of the CRD’s of all registered representatives, only .41% had been the subject of three or more customer complaints. In other words WALESA’s customer complaints rank him in the top one-hundredth percent of all registered representatives for customer complaints.
