Regulator Sanctioned Kochavi For Mischaracterized Securities Transactions
Specifically, on January 16, 2024, FINRA issued Case: 2021071099403 sanctioning Doron Kochavi.
Notably, between January 2017 and April 2019, FINRA claimed that Kochavi incorrectly marked 1,586 transactions in a client's account as unsolicited, where these were really solicited by him. This mischaracterization resulted in Western International Securities Inc., maintaining inaccurate records, violating both Section 17(a) of the Securities Exchange Act of 1934 and Exchange Act Rule 17a-3. Consequently, Kochavi violated FINRA Rules 4511 and 2010, which require the accurate maintenance and preservation of books and records.
In response to these violations, Kochavi consented to a two-month suspension from associating with any FINRA member in any capacity and agreed to pay a fine of $10,000 without admitting or denying the findings. This settlement was formalized through a Letter of Acceptance, Waiver, and Consent (AWC).
Doron Kochavi Disclosed Breach Of Fiduciary Duty Allegations By Western International Securities Inc. Client
Particularly, a client of Western International Securities Inc. contested Doron Kochavi’s sales practices, according to a complaint. Allegedly, Kochavi breached his fiduciary duty. It appears that Kochavi caused the client to sustain damages on stocks. Consequently, Western International Securities Inc. opted to settle the matter on February 8, 2021, by compensating the client in the amount of $2,800,000.
Bear Stearns Investor Accused Kochavi Of Unsuitable Trading
Also, on April 5, 2007, a Bear Stearns client filed a complaint about Doron Kochavi. Supposedly, Kochavi made unsuitable transactions in several accounts, which subsequently declined in value since their opening in 1999. Because of this, the client allegedly sustained damages on stocks and mutual funds. As a result, the client requested compensation from the firm or Kochavi. The matter was closed on January 10, 2009.
Client Accused Doron Kochavi Of Churning
Additionally, a client filed FINRA Arbitration: 03-02292 about Doron Kochavi. Notably, the claim alleged unsuitable recommendations, breach of fiduciary duty, churning, unauthorized trading, and failure to disclose material information. For this reason, on September 24, 2004, a FINRA Arbitration Panel issued an Award ordering Kochavi to pay the client $35,000 in damages, plus interest.
