Mark Atchity Tied To Cabin Securities Investor Arbitration Claim Re: Breach Of Fiduciary Duty

Cabin Investor Accused Atchity Of Misrepresentation, Breach Of Contract, And Unsuitable Advice

Specifically, on April 7, 2026, a Cabin Securities client filed FINRA Arbitration No. 26-00718 about Mark Atchity. Primarily, the client alleged that Atchity breached a contract and fiduciary duty, made unsuitable recommendations, and made misrepresentations and omissions. The client also alleged a failure to supervise. Because of this, the client allegedly sustained damages in connection with real estate securities. Consequently, the client requested $3,500,000 in compensation from Cabin Securities or Atchity. BrokerCheck shows that this arbitration is pending a resolution.

Atchity provided a statement disputing the allegations. According to the statement, the client alleged that the firm failed to perform due diligence, while the firm maintained that it conducted robust due diligence. The statement also indicated that the client consulted a trusted advisor and family member, that the investment’s risks were discussed, and that the sales representative did not participate in managing the investment. Atchity and Cabin Securities deny the allegations.

Mark Atchity Disclosed Poor Performance Allegation By Brookstreet Client

Additionally, a client of Brookstreet Securities contested Mark Atchity’s sales practices, according to FINRA Arbitration No. 07-03590 dated September 15, 2007. Allegedly, the client experienced losses on CMOs. As a result, the client sought compensation from Brookstreet Securities or Atchity in the amount of $650,000 in this matter. The client reportedly named Atchity in the case as Brookstreet Securities’ Chief Compliance Officer and a control person. Atchity denied holding either role. The matter was withdrawn on October 30, 2009.
